Terms and Conditions for ChartReader AI

These Terms and Conditions (“Terms”) govern the access to and use of the ChartReader AI mobile application, website, and related services (“ChartReader AI”, the “App”, or the “Service”) provided by GunzX GmbH (“GunzX”, “we”, “us”, or “our”).

By downloading, accessing, or using ChartReader AI, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you must not use the App.

1. About ChartReader AI

ChartReader AI is an AI-powered educational market research and chart analysis tool.

The App may allow users to:

Upload or capture screenshots or photos of stock, crypto, or other market charts
Receive AI-generated chart analysis and technical insights
Explore possible market scenarios
View market news, social media sentiment, and market context
Access publicly available disclosure data from influential investors, public officials, or institutional filings
Use AI chat features for learning about charts, markets, technical analysis, and trading concepts

ChartReader AI is intended for educational and informational purposes only.

3. Eligibility

You may use ChartReader AI only if you are legally permitted to do so in your country of residence.

The App is not intended for children under the age of 13. If you are under 18 years old, you may use the App only with the consent and supervision of a parent or legal guardian.

By using ChartReader AI, you confirm that:

You meet the minimum age requirements applicable in your country
You are legally allowed to use the App
Your use of the App does not violate any applicable law or regulation

4. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use ChartReader AI for your own personal, non-commercial purposes.

You may not:

Copy, modify, distribute, sell, lease, or sublicense the App or any part of it
Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
Use the App for unlawful, abusive, fraudulent, or harmful purposes
Interfere with or disrupt the App, its servers, or its security systems
Use automated scripts, bots, scraping tools, or similar methods to access the App
Use the App to develop or train competing products or services without our written permission

All rights not expressly granted to you remain reserved by GunzX GmbH and its licensors.

5. No Financial, Investment, Legal, Tax, or Trading Advice

ChartReader AI does not provide financial, investment, legal, tax, or trading advice.

All analyses, insights, explanations, market scenarios, sentiment summaries, alerts, AI-generated outputs, and other information provided by the App are general in nature and are intended only for educational and informational purposes.

The App does not make personalized recommendations to buy, sell, hold, short, trade, or otherwise transact in any financial instrument, crypto asset, security, derivative, or other asset.

You are solely responsible for your own financial, investment, and trading decisions. Before making any financial decision, you should conduct your own research and consider consulting a licensed financial advisor or other qualified professional.

6. Market Risk Disclaimer

Trading and investing involve risk. Stocks, cryptocurrencies, forex, options, derivatives, and other financial instruments may be volatile and may result in partial or total loss of capital.

Past performance, chart patterns, technical indicators, market commentary, public disclosures, sentiment data, or AI-generated analysis do not guarantee future results.

ChartReader AI may provide educational market scenarios, such as bullish, neutral, or bearish interpretations. These scenarios are not instructions, recommendations, or guarantees.

You acknowledge and agree that any decision to trade, invest, buy, sell, hold, or otherwise act on market information is made entirely at your own risk.

7. AI-Generated Content

ChartReader AI uses artificial intelligence to generate chart analysis, educational explanations, market insights, and AI chat responses.

AI-generated content may be incomplete, inaccurate, outdated, misleading, or unsuitable for your specific situation. The App may misunderstand chart images, symbols, timeframes, indicators, context, or user prompts.

You should not rely solely on AI-generated content when making financial decisions. You are responsible for independently verifying all information before acting on it.

We do not guarantee that AI-generated outputs will be accurate, complete, current, reliable, or appropriate for any particular purpose.

8. Uploaded Images and User Content

You may be able to upload or capture chart screenshots, photos, text prompts, or other content through the App (“User Content”).

You are responsible for the content you upload or submit.

You agree not to upload or submit content that:

Contains personal documents, identification documents, private financial account information, passwords, or confidential data
Contains faces, private images, or sensitive personal information
Violates the rights of third parties
Is unlawful, harmful, abusive, defamatory, misleading, or fraudulent
Contains malware, harmful code, or attempts to disrupt the App
Violates applicable laws or regulations

You grant us the right to process your User Content to provide the requested App functionality, including AI analysis, technical processing, support, troubleshooting, safety, and service improvement, in accordance with our Privacy Policy.

You retain ownership of your User Content, but you are responsible for ensuring that you have all rights necessary to upload and use it in the App.

9. Public Market Data and Disclosure Information

ChartReader AI may display publicly available market-related information, such as news, social media sentiment, institutional filings, public disclosures, or reported transactions by public officials or influential market participants.

Such information may be delayed, incomplete, inaccurate, misinterpreted, or subject to reporting limitations.

The display of public disclosure data does not mean that any person or institution currently holds, intends to hold, intends to buy, intends to sell, or recommends any asset.

You must not treat public disclosure information as a recommendation to copy any trade or investment activity.

10. User Account and Security

Some features may require an account, login, device identifier, subscription status, or other access mechanism.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs through your account or device.

You must notify us immediately if you suspect unauthorized access, misuse, or a security breach.

We are not responsible for losses arising from unauthorized use of your account where such use results from your failure to keep your credentials secure.

11. Subscriptions, Payments, and Renewals

ChartReader AI may offer paid subscriptions, in-app purchases, free trials, or premium features.

Payments, billing, renewals, cancellations, and refunds are handled through the relevant app store provider, such as Apple App Store or Google Play, depending on where you purchased the subscription.

Subscription plans may include weekly, monthly, annual, or other billing periods, as displayed in the App at the time of purchase.

By purchasing a subscription, you agree that:

Payment will be charged through your app store account
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
Your account may be charged for renewal within 24 hours before the end of the current billing period
You can manage or cancel your subscription through your app store account settings
Deleting the App does not automatically cancel your subscription
Access to paid features continues until the end of the already paid billing period after cancellation
Refunds are handled by the relevant app store provider according to its own policies

Prices may vary by country or region and may change from time to time. The current price is displayed in the App before purchase.

12. Free Trials and Promotional Offers

We may offer free trials, discounts, or promotional access at our discretion.

Unless cancelled before the end of the trial period, a free trial may automatically convert into a paid subscription, as described at the time of purchase.

Promotional offers may be subject to additional terms, eligibility requirements, and limitations.

13. Fair Use and Usage Limits

To protect system stability, prevent misuse, and ensure fair access for all users, ChartReader AI applies a fair use policy to certain resource-intensive features.

Unless otherwise stated in the App or in a specific subscription plan, paid users may use up to:

100 chart analyses per month, and
100 news, sentiment, or market insight analyses per month

These limits are intended to prevent excessive automated use, abuse, technical overload, and unusually high infrastructure costs.

A “chart analysis” generally includes the upload or capture of a chart screenshot or photo for AI-powered analysis.

A “news, sentiment, or market insight analysis” generally includes requests involving market news summaries, social media sentiment, public disclosure insights, influential investor tracking, or similar market context features.

Unused analyses do not roll over into the next billing period unless expressly stated in the App.

If a user exceeds the applicable monthly fair use limit, access to additional analyses may be temporarily restricted, delayed, throttled, or require the purchase of additional access, where available.

We may adjust fair use limits, technical restrictions, or feature availability from time to time in order to maintain service quality, prevent misuse, and ensure the reliable operation of ChartReader AI.

We may also restrict, suspend, or terminate access if usage appears abusive, automated, fraudulent, unlawful, or harmful to the App, our infrastructure, other users, or third-party service providers.

14. Prohibited Use

You must not use ChartReader AI:

For unlawful purposes
To provide regulated financial, investment, legal, tax, or trading advice to others
To misrepresent AI-generated content as professional advice
To upload confidential, sensitive, or unlawful content
To infringe intellectual property or privacy rights
To scrape, copy, or extract data at scale
To interfere with the security or functionality of the App
To abuse free trials, subscriptions, referral systems, or promotional offers
To attempt unauthorized access to our systems or third-party systems
To use the App in a way that violates app store rules or applicable law

We reserve the right to suspend or terminate access if we believe these Terms have been violated.

15. Intellectual Property

ChartReader AI, including its software, design, user interface, branding, trademarks, logos, features, analyses, generated layouts, text, graphics, and other content, is owned by or licensed to GunzX GmbH and is protected by copyright, trademark, and other intellectual property laws.

You may use the App only as permitted by these Terms.

You may not copy, reproduce, modify, distribute, publicly display, sell, license, or exploit any part of the App or its content except as expressly allowed by us in writing.

16. Feedback

If you send us feedback, ideas, suggestions, bug reports, or improvement requests, you grant us the right to use them without restriction or compensation to you.

We may use such feedback to improve ChartReader AI, develop new features, or modify existing functionality.

17. Third-Party Services

ChartReader AI may rely on or integrate third-party services, including app store providers, payment infrastructure, analytics providers, AI providers, cloud hosting providers, marketing attribution providers, public data sources, news providers, or other technical service providers.

Your use of third-party services may be subject to their own terms, privacy policies, and conditions.

We are not responsible for third-party services, third-party content, third-party data, or the availability, accuracy, legality, or security of external services.

18. App Store Terms

If you downloaded ChartReader AI from the Apple App Store, Google Play, or another app store, your use of the App may also be subject to the terms and policies of that app store.

The app store provider is not responsible for providing maintenance or support for the App, except where required by applicable law.

Apple, Google, and other app store providers are not parties to these Terms, but they may have rights as third-party beneficiaries where required by their applicable terms.

In the event of a conflict between these Terms and the applicable app store terms, the app store terms may apply to the extent required by the app store provider.

19. Availability and Changes to the App

We aim to keep ChartReader AI available and functioning, but we do not guarantee uninterrupted, error-free, or permanent availability.

We may modify, update, suspend, discontinue, or restrict any part of the App at any time, including features, pricing, subscription plans, usage limits, supported countries, or technical functionality.

We may also perform maintenance, updates, or security improvements that temporarily affect availability.

20. Disclaimer of Warranties

ChartReader AI is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we make no warranties or representations of any kind, whether express, implied, statutory, or otherwise, including warranties of:

Accuracy
Completeness
Reliability
Availability
Fitness for a particular purpose
Merchantability
Non-infringement
Suitability for financial, investment, or trading decisions

We do not guarantee that the App will meet your expectations, generate correct analyses, detect all chart patterns, identify all risks, or produce any financial outcome.

21. Limitation of Liability

To the fullest extent permitted by law, GunzX GmbH, its directors, employees, contractors, affiliates, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages.

This includes, without limitation, damages arising from:

Trading or investment losses
Reliance on AI-generated content
Inaccurate, incomplete, delayed, or unavailable market data
Misinterpreted chart images
App errors, bugs, outages, or interruptions
Unauthorized access to your account
Loss of data, profits, revenue, business, opportunity, or goodwill
Third-party services or third-party content

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.

22. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless GunzX GmbH, its directors, employees, contractors, affiliates, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of applicable law
Your User Content
Your infringement of third-party rights
Any financial, investment, or trading decision made by you or based on your use of the App

23. Suspension and Termination

We may suspend, restrict, or terminate your access to ChartReader AI at any time if:

You violate these Terms
You misuse the App
Your use creates legal, security, operational, or reputational risk
We are required to do so by law, regulation, court order, app store provider, or competent authority
We discontinue the App or a relevant feature

You may stop using the App at any time. If you have an active subscription, you must cancel it through your app store account settings to stop future billing.

24. Data Protection

We process personal data in accordance with applicable data protection laws.

Details about how we collect, use, store, and share personal data are described in our Privacy Policy.

By using ChartReader AI, you acknowledge that you have read our Privacy Policy.

25. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may notify you through the App, by email, or by other appropriate means.

The updated Terms will apply from the effective date stated in the new version. Continued use of the App after the effective date means that you accept the updated Terms.

If you do not agree to the updated Terms, you must stop using the App.

26. Governing Law and Jurisdiction

These Terms are governed by the laws of Austria, excluding conflict-of-law rules, unless mandatory consumer protection laws in your country of residence provide otherwise.

The competent courts of Austria shall have jurisdiction to the extent legally permissible.

If you are a consumer residing in the European Union, you may also benefit from mandatory consumer protection rights and jurisdiction rules applicable in your country of residence.

27. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain valid and enforceable.

The invalid or unenforceable provision shall be replaced, to the extent legally permissible, by a valid provision that most closely reflects the economic and legal purpose of the original provision.

28. Entire Agreement

These Terms, together with our Privacy Policy and any applicable subscription or app store terms, form the entire agreement between you and GunzX GmbH regarding your use of ChartReader AI.
